Public & Products Liability for EA Affiliated Clubs

This policy provides cover for your legal liability for compensation arising from personal injury or property damage.

Under the Public and Products Liability section coverage is provided for the club:

The promotion and/or organisation of and/or participation in and/ or attendance at Equestrian Activities and/ or Associated Events (including social and fundraising activities) or interests all in connection with Equestrian Australia Limited and the State Branches thereof.

And for Insured Persons (such as Club Members, Volunteers, Officials, etc);

The direct participation by the Member in activities (including social and fundraising activities) organised and/ or run by the affiliated association or affiliated club of which they are a member but excluding whilst travelling to or from such activities.

In effect, this means the Club and Insured Persons are protected should you cause personal injury or property damage to Third Parties and you are held legally liable, whilst engaged in club activities.

Loss includes, but is not limited to:

  • Damages
  • Legal Advisor’s fees and court costs
  • Reasonable Expenses incurred with the Insures written consent  (these do not include loss of wages, loss of earnings or profits)

If an allegation is made against you, under no circumstances are you to admit liability. Please contact Gow-Gates immediately should you become aware of any situation which could lead to a claim.

Cover is provided

Anywhere in Australia and New Zealand and anywhere in the world where the insured is travelling for equestrian activities and is normally a resident of Australia and/or New Zealand.

An example of a claim under the Public Liability section :

  • A participant is injured when they fall at a broken fence on the cross country course. They sue the host club for failing to provide a safe environment. The EA National Insurance programme Public Liability policy would cover the defence costs and damages payable by the club.

An example of a claim under the Product Liability section :

  • A spectator contracts food poisoning after purchasing a pie from the club canteen. They sue the pie manufacturer, as well as the club. The EA National Insurance programme Products Liability section would cover the defence costs and damages payable by the club.
