Professional Indemnity for EA Affiliated Clubs
This policy provides coverage for the Insured’s legal liability for a breach of professional duty in the sport by reason of an act, error or omission committed by or on behalf of the Insured.
Under the Professional Indemnity section coverage is provided for the club:
The promotion and/or organisation of and/or participation in and/ or attendance at Equestrian Activities and/ or Associated Events (including social and fundraising activities) or interests all in connection with Equestrian Australia Limited and the State Branches thereof.
And for Insured Persons (such as Club Members, Volunteers, Officials, etc);
The direct participation by the Member in activities (including social and fundraising activities) organised and/ or run by the affiliated association or affiliated club of which they are a member but excluding whilst travelling to or from such activities.
In effect, this means you are protected should you or one of your Insured Persons, in your capacity as an EA Affiliated Club, provide professional advice which results in a loss being sustained by a third party, for which you are legally liable.
Limit of Liability
| Limit of Liability: | $20,000,000 |
| Excess: | $2,500 |
Cover is provided
Anywhere in Australia and New Zealand and anywhere in the world where the insured is travelling for equestrian activities and is normally a resident of Australia and/or New Zealand.
It must be noted that the Professional Indemnity policy is a claims made policy.
This means that the policy indemnifies for claims first made against you and notified to the Insurer during the period of insurance. It is therefore extremely important that notification is given immediately to Gow-Gates Insurance Brokers Pty Limited or the Insurer as soon as you are aware of any circumstance that may lead to a claim.
If an allegation is made against you, under no circumstances are you to admit liability. Please contact Gow-Gates immediately should you become aware of any situation which could lead to a claim.
Example of a claim under this section:
- A rider falls from their horse at a club event. The designated First Aid Officer assisted the injured rider, who complained of a sore back. After some basic assessment, the First Aid Officer advised the rider to try to sit up. The rider suffers further injury following this advice and sues the Club’s First Aid Officer. The EA National Insurance Programme Professional Indemnity Policy would cover the defence costs and damages payable by the Club and/or First Aid Officer.
